MAGA Justices Rule Against Life-Saving Care For Trans Youth And Deal Blow To Equal Protection Clause

Washington, DC – In response to today’s 6-3 Supreme Court’s ruling upholding Tennessee’s ban on gender affirming care for transgender youth, Demand Justice Interim Executive Director Maggie Jo Buchanan released the following statement: 

“This ruling fails to consider the horrific impacts of denying life-saving care to kids. It further endangers a community that already faces daily discrimination–and as Justice Sotomayor wrote in her dissent, the majority ‘authorizes, without second thought, untold harm to transgender children and the parents and families who love them.’ 

“Three of the MAGA justices even went out of their way to express their own, personal opposition to the basic premise of equal rights for transgender people.

“Every person, every kid, deserves compassion and access to the care they need. This attack on the Constitution, and families, will have devastating consequences for our nation.” 

In the last paragraph of Justice Sotomayor’s dissent, she writes that this ruling “does irrevocable damage to the Equal Protection Clause and invites legislatures to engage in discrimination by hiding blatant sex classifications in plain sight.” 

This ruling also comes soon after the Trump administration began cruel cuts to LGBTQ+ specific services for anyone who calls the national suicide prevention hotline.
