Extremist judges are having an overwhelming impact on abortion care in our nation. In addition to the Supreme Court’s devastating decision to overturn Roe v. Wade, the scene is set in the lower courts for even more regressive decisions to come.   

Judges who have made radical statements and issued harmful decisions, like those featured below, cannot be trusted to rule with the best interests of the public in mind. Already, over 70 percent of Americans across the political spectrum believe that judges have too much power over our laws and regulations. This power allows rogue judges to enact policies through the courts that would never pass through other legislative means. 

This is not how our democracy is meant to function–we need more fair-minded judges on the courts who will rule to protect our rights and freedoms, not eliminate them. 

Judge Justin Walker – D.C. Circuit 

  • While discussing now-Justice Kavanaugh’s nomination to the Supreme Court, Walker was gleeful in predicting, “a conservative revolution…abortion will see drastic changes.”

Judge Andrew Brasher – Eleventh Circuit 

  • While speaking at a political rally, Brasher crowed: “The ACLU and Planned Parenthood want a fight and we will give them one.”

Judge John K. Bush – Sixth Circuit

  • Former far-right blogger Bush called abortion rights one of America’s “greatest tragedies,” and insulted the freedoms that Roe v. Wade enshrined as only the result of “activist judges.” 

Judge Steven Menashi – Second Circuit 

  • In his editorial titled “The Yuck Factor,” Menashi mocked those who support abortion rights as “campus feminists,” calling Roe v. Wade itself “radical.” 

Judge James Ho – Fifth Circuit 

  • Has shamed and demonized those who have sought out care by referring to the “moral tragedy of abortion” in his judicial opinions. 

These are statements that show clear bias on abortion and the equality of women overall, which are topics that are top of mind for many people in this country as women are put in life-threatening, and preventable, situations and have had their rights stripped away due to the Supreme Court’s decision to overturn Roe

American law is being distorted due to blatant activists like these on the bench. The public deserves a fair-minded judiciary, not one that seeks to force a far-right ideology on the entire country.
