Washington, DC – Yesterday evening, the Senate voted to confirm Emil Bove III to the U.S. Court of Appeals for the Third Circuit by the slimmest of margins–putting an infamous Trump loyalist, and one that faces serious allegations of misconduct by multiple whistleblowers, in a lifetime seat. His nomination, and confirmation, underscored the grave threat Trump’s nominees pose to our courts and democracy.
Today, Demand Justice launched a new resource that will track and score the votes of all 100 Senators on Trump’s judicial nominees. During his first term, President Trump and Senate Republicans confirmed 234 judges to the federal bench, many of whom did his bidding long after he left office. On average, the Democratic Senators still serving today voted over 40% of the time to confirm those nominees to the bench–however, at this point in Trump’s second term, other than Sen. King’s vote to confirm Joshua Divine, the Democratic Caucus has overwhelmingly stood firm against his second-term nominees. That posture must continue in order to protect our democracy.
In contrast, the Republican members of the Senate have consistently greenlit Trump’s nominees. Even Sens. Collins and Murkowski, who voted against Bove last night, have helped secure the confirmation of other Trump nominees–even those with deeply alarming records on abortion rights.
Since Bove’s nomination was announced, Demand Justice has been mobilizing against it–on Monday morning, the organization delivered whistles to all Senate offices, calling on Senators to listen to the now-multiple whistleblowers who have first hand knowledge of Bove’s deeply concerning misconduct at the DOJ. On Sunday, the organization put up signage around Capitol Hill showcasing texts from the whistleblower that indicate Bove suggested the department ignore court orders.
